Passage of a bill to allow a change of sex designation on the birth certificate of transgender children

CONSIDERING THAT the May 2015 report from the Committee on Institutions on the special consultations and public hearings on the draft regulation concerning the Regulation respecting change of name and of other particulars of civil status for transsexual and transgender persons calls upon the government to act without delay in order to support minors and emphasizes the urgency of the situation;

CONSIDERING THAT the sex designation that appears on the birth certificate dictates the sex designation on other identification documents, such as the Health Insurance Card, permanent code, student card, driver’s license and passport;

CONSIDERING THAT minors are authorized to request a change of sex designation in other Canadian provinces, such as British Columbia, Alberta and Ontario;

CONSIDERING THAT under the Québec and Canadian Charters of Rights and Freedoms, every individual has the right to equality and to the respect of privacy, which cannot be achieved without having documents that match one’s appearance and gender identity;

CONSIDERING THAT transgender youth experience disproportionate levels of discrimination, a situation that is exacerbated by the fact that they are unable to obtain identification documents that match their appearance and gender identity;

We, the undersigned, ask the Government of Québec to introduce and adopt a Bill that will allow transgender children to have the sex designation appearing on their birth certificate changed without delay.
